In fact, Donald Trump talked to Republican leaders about considering his third term as President. Regarding his ability to remain in office after the completion of his second term after four years, Trump said, ‘I suspect that I will not run for re-election unless you (supporters) say something else.’ However, after his statement, questions have started being raised whether it is legally possible for him to contest elections for the third time? It is worth noting that Trump may be joking by saying that he will contest elections for the third term, but under the 22nd Amendment to the US Constitution, he can be prevented from doing so. Can Trump contest the presidential election for the third time in 2028?
For Donald Trump to contest for a third term, he will have to repeal the 22nd Amendment of the US Constitution. To repeal the constitutional amendment, Donald Trump would need the support of both two-thirds of the House (290 members of the House) and 67 members of the Senate. Once this happens, three-fourths of all the states i.e. 38 members will also have to agree. It is believed that in view of the opposition from Democratic MPs, it will not be easy for Donald Trump to repeal the 22nd Amendment. Apart from this, some Republicans may also oppose it.
What is the 22nd Amendment that stops Trump?
The 22nd Amendment to the US Constitution only says that a person elected President twice cannot contest elections for a third term. The constitutional amendment states, ‘No person shall be elected to the office of President more than twice.’ It further provides that and no person who has held the office of President or has acted as President for more than two years during the elected term of another person shall not be elected to the office of President more than once .’ President George Washington had set an example by remaining in office for only two terms. However, President Franklin D. Roosevelt went against this unwritten precedent and held the presidency four times. He is the only and first person in America to do this.
