Donald Trump is trying his best to avoid this. But the judge is in no mood to show mercy. A New York judge on Monday rejected US President-elect Donald Trump’s petition. In this petition, Trump had demanded to postpone the announcement of sentencing on January 10 in the hush money case.

Justice Juan Marchant had ruled last week that Trump’s sentencing hearing should take place on Friday, despite the proximity of his swearing-in ceremony. He had rejected Trump’s lawyer’s argument that the matter should end after his election victory. Justice Juan Marchen said in his two-page decision that prosecutors had opposed postponing the sentence. It was said that if Trump does not try to make it successful by filing an appeal in the higher court at the last moment, then the hearing should be held on time.

Justice Juan Marchen said, ‘This court has considered the arguments of the defense and found that these arguments are mostly the same which they have raised many times before.’ The judge said, ‘The petition by the defense side seeking a stay on these proceedings is rejected, which also includes the demand to postpone the sentencing hearing to January 10, 2025.’ Merchant has given Trump the option of appearing in person or virtually at Friday’s hearing. He has said that he is not in favor of giving jail sentence to the former and future President. It is worth noting here that Trump is the first former President to be convicted of any crime.

Trump is guilty in 34 cases
In fact, Trump’s lawyers had appealed to the judge to postpone the sentence until the hearing on his appeal against the verdict given by a Manhattan jury is completed. Trump was convicted in May on 34 counts of falsifying business records. He did this manipulation to give hush money to porn star Stormy Daniels before the 2016 presidential election, so that she could not disclose his alleged sexual relationship with her in 2006.

On what basis is the demand for dismissal?
Trump’s supporters stormed the US Parliament while trying to overturn his 2020 defeat. Four years after this incident, on Monday Trump was declared the winner of the 2024 presidential election. His swearing-in ceremony is to be held on January 20. Trump’s lawyers had sought to dismiss the case on several grounds. This also includes the historic decision of the Supreme Court last year, which said that former US Presidents enjoy broad immunity from lawsuits for many official actions taken during their tenure.
