Delhi court issues show cause notice to police officials for lapse in 2018 acid attack case

NEW DELHI: A Delhi court recently issued a show cause notice to two Delhi Police officials, asking them to explain why departmental action should not be initiated against them for a serious lapse on their part in acid attack case which resulted in the destruction of evidence.
The court of Additional Sessions Judge Dhirendra Rana, in an order dated December 13, said, “Perusal of the record reveals that despite the fact that spots of acid were found by the crime team on the mattress of the bed on which the victim was sitting at the time of the incident, first investigating officer (IO) sub-inspector (SI) Sandeep did not seize the same.”
The matter has been posted for further proceedings on February 28, 2025.
Advocate Ravi Drall who appeared for the victim, said, “Step taken against police official is in interest of justice. Delay on part of investigation agency helps accused person to take bail and leads to acquittal. In present case also FSL from mattress is negative because the mattress wasn’t seized at time due to which forensic department was unable to reveal the material used to pour inside mouth of victim.”
The court was hearing a case registered by the Shahbad Dairy police station under various Indian Penal Code provisions, including 326A (acid attack), 328 (causing hurt by means of poison etc.), and 342 (wrongful confinement).
The case is at the stage of examining prosecution witnesses.
According to the complainant, she was wrongfully confined and beaten by her husband and in-laws, who also administered her some acid-like substance, causing permanent damage to her left eye.
The FIR stated that the complainant’s in-laws pinned her, wrapped a chunni around her neck, and beat her, following which her husband forcibly administered some acid-like substance in her mouth on June 17, 2018.
The court, noting that only at a later stage, the mattress and saree of the victim were seized by the second IO, SI Ved Parkash, said, “Therefore, issue a show cause notice to IO SI Sandeep and IO SI Ved Parkash to explain why departmental action be not initiated against them for the serious lapse on their part which resulted in destruction of the evidence in this case.”
During the proceedings, the court was informed that one of the accused, Rakesh, expired. The court then sought the death verification report from the prosecution.
